O leil\u00e3o, realizado no dia 25 de agosto, estava em fase de recursos, com previs\u00e3o de homologa\u00e7\u00e3o do resultado pela Ag\u00eancia Nacional de Transporte Terrestres (ANTT) no dia 27 de outubro. A expectativa de investimentos chega \u00e0 casa dos R$ 13,1 bilh\u00f5es, em 30 anos de concess\u00e3o, com a expans\u00e3o e a melhoria das rodovias, al\u00e9m de custos operacionais como servi\u00e7o m\u00e9dico, mec\u00e2nico e pontos de descanso para os caminhoneiros.<\/p>\n<p>A DPU alega que as comunidades quilombolas Feixo, Restinga e Vila Esperan\u00e7a de Mariental, localizadas dentro dos limites do munic\u00edpio da Lapa (PR) e que re\u00fanem cerca de 600 fam\u00edlias, seriam prejudicadas com o pagamento do ped\u00e1gio instalado no km 191 da BR-476, entre as comunidades e a cidade. Essas comunidades s\u00e3o certificadas pela Funda\u00e7\u00e3o Cultural Palmares, desde 2006, como sendo tradicionais.<\/p>\n<p>A ju\u00edza federal S\u00edlvia Regina Salau Brollo acolheu o argumento da DPU de que os integrantes dessas comunidades, para terem acesso aos servi\u00e7os p\u00fablicos b\u00e1sicos prestados pelo munic\u00edpio, como sa\u00fade, educa\u00e7\u00e3o e acesso \u00e0 Justi\u00e7a, v\u00e3o ter de passar necessariamente pela pra\u00e7a de ped\u00e1gio.<\/p>\n<blockquote><p>Esse \u00e9 um caso emblem\u00e1tico porque promove o resgate do direito \u00e0 consulta livre, pr\u00e9via e informada das comunidades tradicionais, ressaltando que ela n\u00e3o se confunde com as audi\u00eancias p\u00fablicas realizadas. Com a liminar concedida, fica suspenso o leil\u00e3o e ser\u00e1 poss\u00edvel se buscar a participa\u00e7\u00e3o efetiva no processo de concess\u00e3o das comunidades quilombolas afetadas\u201d, analisa o defensor regional de Direitos Humanos, Rodrigo Zanetti.<\/p><\/blockquote>\n<p>&nbsp;<\/p>\n<p>O defensor informou que o caso chegou a DPU pelas pr\u00f3prias lideran\u00e7as das comunidades quilombolas afetadas.<\/p>\n<p>A decis\u00e3o de suspender o leil\u00e3o levou em conta tamb\u00e9m o dispositivo da Conven\u00e7\u00e3o 169 da Organiza\u00e7\u00e3o Internacional do Trabalho (OIT), que determina \u201ca consulta aos povos interessados, mediante procedimentos apropriados e, particularmente, atrav\u00e9s de suas institui\u00e7\u00f5es representativas, cada vez que sejam previstas medidas legislativas ou administrativas suscet\u00edveis de afet\u00e1-los diretamente\u201d. Assim, os efeitos do leil\u00e3o do lote 1 ficam suspensos enquanto a a\u00e7\u00e3o principal n\u00e3o for apreciada pelo Poder Judici\u00e1rio.<\/p>\n<h4><strong>Leil\u00e3o<\/strong><\/h4>\n<p>O primeiro lote abrange uma extens\u00e3o total de 473 km, compreendendo as rodovias federais e estaduais: as BR-277\/373\/376\/476 e as PR-418\/423\/427.
